Right to Practice

Section 30 of the Advocates Act was notified in 2011, post which it was believed that Advocates will now be entitled to practice through out India without having to transfer their Sanad. A 2016 judgment of the Hon'ble Supreme Court (upholding a Division Bench Judgment of Hon. Alld. HC) held that right to practice is not absolute and certain restrictions can be laid by the HC. I wanted to understand what is the current position in this regard? Specially, if I have already made an application for transfer and start practicing at my proposed place of practice (say the Bombay High Court- both original & appeallete side), will I be allowed to do so?

Yes! You can Practice in Mumbai Highcourt.
