rights on child of remarriage

Dear Lawyers, Kindly help me with my queries: Me and my husband are remarried after our first marriage was a disaster and we have a son each born of earlier marriage. Now the kids are with me and my husband stays abroad.I am currently looking for some job offers abroad to take my family with me. My husband now says I will have rights to take only my biological son with me and the other son I cannot take with me as there are legal tangles that dont permit me even to take him in domestic flights.He says courts doesnt look at him as my son and I have to go to court for taking legal authority on him.Is it so complicated? Dont I have rights on him? Kindly clarify. Regards Kavitha R

Had you get permanent custody of your son from the court while your divorce or your husband had got visitation rights to visit his son ? he is absolutely your son and you have all rights on him you are his biological mother, you have all such rights as a mother on her son, but your second husband is not his father for that he had to legally adopt him as a son then your son will become his son for that you can consult a local lawyer .
