wife can  get the information of husband property under RTI act ? PLEASE SUGEST any case law ?

Dear querist,

 

Yes, she can take information but PIO in routine manner deny these type of information under section 8(1)(j) of RTI act, then First Appeal then CIC. This one long route in case PIO denies (Approx 2 years).

Better to go viva court.

Wife might not succeed as matter already in court, RTI wont apply. If in case through court she cannot get relief, RTI will come handy.  Perhaps it will take 2-3 years, but she will 100% get relief through RTI final appeal.

If she knows exactly where property is there, she can get certified copies through Sub-Registrar Office.  Otherwise, file application in the court asking the other party to submit property details on affidavit.
