Mr. Mehrotra has had an impeccable record of undertaking challenges and working diligently. He was however superseded by a person two years his junior when it came to becoming the Head of his section. Agonised by this decision, Mr Mehrotra filed an RTI application with the PIO of his organisation to know why he was not in contention for the promotion and what were the notings by his superiors in his ACRs.

 

  1. (a) Are file notings pertaining ACR open to Mr. Mehrotra? Do any conditions apply in this regard? If yes, state them.

 

  1. (b) Is the person who superseded Mr. Mehrotra a Third Party? Give reasons for your answer.
