Rti to pf offcice reply

Dear Experts,

        I got a  my RTI reply from PF office nagpur. In my my RTI application I asked about a particular direction given to area inforcement officer.CPIO replied that "Copies of direction given to area inforcement officer are enclosed". But CPIO hasnot attached the copies with the reply.

What to do now?

Should in file 1st appeal?

@ Adv Patil,

Thanx for your quick reply,

But in the reply it is mentined that the copy hasbeen attached,they havenot asked any amount from me. Moreover I clearly wrote in my application that

"As per section 7(3) of the RTI Act 2005, In case, there are further fee required to provide the requested information, I request the PIO to inform me of the additional fee amount along with the calculations made to arrive at the amount."

I think CPIO havenot attached the directions intentinaly.Because if they will attach the copy of the direction given to Area inforcement officer,based on the direction i will file a RTI. Just they donot want to privide information thats the only reason CPIO havnot attached the copy of direction.

I think i should go for 1st appeal for the denial.

File First Appeal under RTI Act with following grounds:

Grounds for Appeal: Incomplete, incorrect information, misleading  provided by PIO.  The purported enclosures to his letter are not received by the Applicant.  Hence this first appeal treating it as deliberate, deemed denial and providing incorrect, and incomplete information.

PRAYER: CPIO may be directed to provide such enclosures which were not provided with his reply as expeditiously as possible by Regd., Ack due free of cost, explaining reasons for misleading information that copies of directions were sent, without actually ensuring that copies are properly enclosed to his reply.

 

PS: This may also be due to clerical  error.  Please send first appeal enclosing copies of  of RTI Application and CPIO reply and send the same by Regd., post.  Is there any marks of stapler on reply ( two small holes on Top left ?)

After receiving enclosures, file another RTI Application enclosing such directions and seek information on action taken on such directions, reasons for delay, names of officers for such delay, the probable date by which action can be taken, time frame fixed for following directions under citizen charter

Thanx a lot for your reply.

Sir there is no stapler pin mark of attachment (It may be a clerical error also). To get the required information I will file 1st appeal as guided by you.I will also post the reply revd from 1st appeal in this forum as soon as i get.

it can be a clerical error.  You can before filing appeal and wasting another one month contact personally or telephonically.

I spoke to CPIO today,it was a clerical error.They have emailed me withing 1 hour of recieving my call.

But in the email they have mentioned " With reference to your application dated ........, we have already submitted information vide our letter No. .......... dated .............. and further to your telephone call dated 16.7.2014, once again we are sending the information as attached here with."

From the attachment i came to know that there is one more complain like mine.But his amount was deposited after his complain. The AEO was twice intimated for submitting the report but he has not submitted.I think the AEO is also responsible for this and he may have good understanding with the employer.

Any suggestions for filling the next RTI regarding this matter.

@ GLN Prasad has already given sugession for the same

No clerk will ever conceded in writing that he forgot to attache enclosures to letter even if he is proving the same again.

be clear :-

 

  • RTI is not a greivance redressal mechanism
  • RTI is not a tool to compel Govt servant to do duty.

 

If you suspect connivance of AEO then write detailed complaint to CVO of EPFO

I think expert Mr. Sudhir Kumar has advised more than sufficient on this issue nothing more to add.
