Sale deed with hold of developer. experts please advise.

 

With out sale agreement,  I have bought  a property directly registered on my name, 3 months ago by paying 40% of the total amount. The sale deed is executed on my name. The venture owner gave me photo copies of the sale deed and the original documents are with him now. He sold it to me for 500/- per Sq.Yrd. But actual value is 200/- only. Till now, I have paid the amount, (equal to 200/- per Sq.Yrd). Because he cheated me, I asked him to resale the plot and and return me my amount.  He is not willing to resale it.

There is no aggrement or promisary note or any legal document that states am still due to pay him. How can i get my documents back.

When the developer refuses to part with the original, the following courses of action could be initiated:                    a. Please apply for a copy of the original from the sub-registrar where the sale deed is registered. This is possible when the original document is lost. A complaint with the police for the loss of document and subsequent copy from the sub-registrar will make the developer to come forward.

Venkat Sir,

If i give a police complaint, they will go for enquiry to the mentioned seller's adress. Sellers adress is clearly seen on the sale deed. Then the developer will say that, am still due to pay him. How can i come through this situation?

the first question states a different sets of facts. If that is correct, the second question will not arise. It has an obvious answer inherent in the two questions
