Sale of property after stay order

hello there

in 2013 as a tanent stay order was passed by lower court, now in 2018 the property has been sold to third party. 

1. stay order was to adopt legal proceure for getting the property vacated by owners from tanent.

2. the case is still on in lower courts, and sale of property can be challenged ?? if yes kindly inform the section under which it can be challanged.

U can challenge it but winning chance is 50:50 only.uhave to make the purchaser as additional party u.o 1r.10 CPC read with section 151,CPC. In present case.

hello ,
I had given token amount to buy a flat in Malad which is a resale flat of 20years old . but the flat kitchen portion is encroached an termed as illegal . so the bank is not granting a disbursement on that flat . now the token amount given to the seller she is refraining on the terms the purchaser cancelled the deal so the token cannot b given back . but the bank clearly told me to get the noc from society supporting the construction of the extra part and bmc approval which also she is not able to provide . please suggest how to get the refund of the token in this case

U issue a legal notice thru Ur advocate to re fund the advance money for the above reasons if she refuses then file a suit for recovery of advance money in competent court.
