Sale of society, how can builder manage it?

Hello I am member of a co operative housing society(which has two buildings each having 12 flats, in total 24 members in pune-maharashtra) and group of members are trying to sell the society(as the society is situated in prime location of pune). They could not sell society legally due to laws or objection of few members uptill now. Now they are threatening that they will purchase Individual flats along with "members rights in society", to this 90% members are ready and willing to sale their flat but I do not wish to sale my flat at suggested rate and Builder/ Group of member who is doing this deal is not ready to give me a descent deal, so if I want to opposse this process what legal options do I have? can they desolve the society? can they demolish society construction with out me saling the flat and still leaving in it? Can I take stay to Desolving society or oppose to builder buying 90% flats of society. What if I don't sale and don't leave the possesion of flat?

Dear Vijay

Neither the builder nor the society can legally force you to sale your owneship Flat. Its your and your will that will matter here. You need to formally keep informed concerned Municipal Dept  with your "Objection"  for issuance of any redevelopment permission to your said building.

However, subject to your wish, if 90% of members are ready to sell, better you should also go with majority perhaps you may get better and new Flat in a newly built bldg for your family.

Thank you for your reply Ibrahim. My biggest worry is that can the builder buy 90% flats in society and dissolve/Liquidize society. Builder wants to use society land for commercial purpose not for redevelopment. Can builder stop/interrupt me from using societies common amenities like water, electricity, common areas, parking etc. Is it possible for him to start demolishing parts of building legally? Can he demolish Society Infrastructure legally?

I would like to be part of deal but people(few members of society) handling this deal has taken a stand that take what builders gives or be on your own. They have manipulated the money distribution by showing wrong Carpet areas of flats. My simple argument that give me a flat in area near of present society and some amount as compensation, but they don't agree to it. Nothing is done under society's authority. chairman, secretary are totally in favor of builder.  Please suggest legal options or what shall I do?
