Between sanity and insanity there is a very thin line in all human beings, better consult second test from a reputed doctor.

1. During any Legal Dispute /Claim /Stake /whatever .... the Court recognises a proper assessment and report of only a Govt. Hospital Doctor and NOT a private doctor's assessment report /opinion.

2. Visit the State Govt. /Municipal Hospital and have yourself evaluated for mental stability etc.... which includes mental disease ie schizophrenia.  This Govt. report shall be legally conclusive & final for all purposes, including Govt. Job, Education, Marriage, Monetary claims, Insurance etc....

What are the facts?  Please post material facts, esp. as to "He reported....." To whom -why? What are the background facts?

T. Kalaiselvan, Advocate (Advocate)     01 April 2020

You do not have to prove that you are not a mentally ill patient.

It is for the opposite party to prove this with substantial evidence.

If they produce any evidence than you may also produce evidence in the form of an opinion obtained from another specialist doctor.

This is not a big issue, you can discuss with your advocate on the strategies to be adopted in this situation.

What are the facts and dispute for consideration and obligation of experts vis-a-vis your locus standi / concern ?

Greeting as mentioned by the other learned experts, the party that alleges something is the party that must prove the same. Therefoer, if your spouse alleges that you have the said disease then he/she will have to prove the smae in the Court as the burden of evidence lies on them. the Court on this petition might ask for a medical checkup confimring or denying the same. You may refer to thsi Article for more details on the same https://www.lawyersclubindia.com/articles/Grounds-for-Divorce-under-Hindu-Marriage-Law-22.asp

Hope this helps.
