you have to first obtain divorce and after that you have to pass the iddat period (3 menstrual months) then you can go for 2nd marriage...in Muslim law the lady can't take talaq it is called Kulah...this is the rule under the sharait and the muslim prevailing here.

without taking talak from your previous husband you are not entitled to get marry. if you do so it is punishable offence u/s 494 ipc .
