Hello Sir/Maam,

There is no specific section of attemp to rape as it waas decided by Supreme Court in the case as mentioned below.

Chaitu Lal vs State of Uttarakhand has upheld the conviction of a man under Section 376 read with Section 511 of the Indian Penal Code for attempt of rape of a woman. The Apex Court has minced no words to make it clear that the attempt to commit an offence begins when the accused commences to do an act with the necessary intention.

It is imperative to mention right at the beginning that the Supreme Court just recently on November 20, 2019 in a latest judgment titled Chaitu Lal vs State of Uttarakhand in Criminal Appeal No. 2127 of 2009 has upheld the conviction of a man under Section 376 read with Section 511 of the Indian Penal Code for attempt of rape of a woman. The Apex Court has minced no words to make it clear that the attempt to commit an offence begins when the accused commences to do an act with the necessary intention.

I hope this helps you with your query

regards,

Varnita ojha
