Served partial notice period

Hello ,

I was working with a renowned developer company in Noida as a sales executive , wherein the notice period was supposed to be for one  month and i was keen upon serving 15 days notice period. ( as the remaining 15 days dues can be adjusted against  my full and final settlement , assuming that the company would not be paying me instead charging me for it ) 

My resignation was accepted but while i was serving the notice period thr HR head started spreading bad name in the company ( as she was keen to retain me , for which i refused )

At the end of the 16th day of my notice period i handed over the documents and various material to the reporting manager marking a mail to the HR HEAD AND SALES HEAD as well.

Now i have already completed a month and she is refusing to provide me the relieving letter replying to it that i did not served the full notice period which is compulsory and would only give me the FNF cheque.

I need the relieving letter as i worked for this company for an year and was a performer.

Need help!!

You may submit a written representation by letter under acknowledgment followed by email to your appointing authority, MD, HR Head, Company secretary, and narrate the incidents date wise and  request their good offices to intervene and supply you your acceptance of resignation, service certificate, F&F, settlement of a/c and payment of dues, relieving letter, Form 16,NOC/NDC,PF accumulation reports, PF withdrawal/transfer forms ,etc.

Since you were an outstanding performer you can highlight all your achievements for the company and issue you relieving letter.

Company cannot deny supplying service certificate. Company can sit on relieving letter. In case of any difficulty you can approach o/o labour commissioner, and/or issue lawyer's notice.

Dear Sir,

I am working with an organization as Graduate Engineering Trainee and also i am on probation period

I have submitted 30000/- rupees as security deposite to serve the company for 2 years.

Against the security deposite they have clearly mentioned in my appointment latter that my security deposite will be forfited by organization if i don't serve for 2 years. 

With reference to my appoinment latter it is mentioned that i am supposed to complete 30 working days notice period or early rlieving can be settle down by pays of remaining days to complete 30 days.

With perior to my resignation i have intimated to repective HOD, personnel and HR department several times for early reliving but none of my request heard and scolded badly.

I have tried to complete all the handing over activites but with reference my early reliving and prior intimation they have sent me a notice for resuming notice notice or they can take any legal action that they want.

Sir, I seek your help on this matter.

Did you deposit security money by cash, or by cheque or by DD? Has the company issued any receipt? Is the amount of security deposit collected from you by company mentioned in your appointment letter?

Did you consult the elders in the family or experienced and competent well wishers before depositing security money and accepting the job offer? You should have and you should always otherwise you shall continue to face such situations. If your CTC is say @Rs.15000/pm, you shall be losing 4 months CTC i.e. Rs.60000/ and on the top of that you are being scolded and are not being allowed to exercise your rights.

The act of the company to collect security deposit is unethical, and the scolding etc is bad conduct.

You may show all docs to  the elders in the family or experienced and competent well wishers, and a lawyer/law firm and with their advice lodge a  complaint with o/o Labour Commissioner, and demand to get your security money with interest, service certificate, acknowledgment of the notice of resignation, acceptance of resignation, settlement of a/c, F&F, form 16,relieving certificate, PF accumulation reports, PF withdrawal/transfer forms, NDC/NOC etc. You may mention that you are a trainee and your notice period is 30 days.

Dear Sir, Thanks for your response. I have deposited 15000 through DD and emi of 5000 were been deducted from my salary. With prior to my resignation and about my reliving i have intimated the respective personal like HOD, personeel and HR department through mail and also through personally about 17 days before. I have requested them several times but they were not hearing me and i am reciving a reply from my HOD that you will be relieved according to companies requiremnet. i have recieved a reply that "you can't go until i leave you". The conditions were prettymuch misrable to withstand so i have left the company. I request you to guide me in this matter. Same

Company has declared you absconding, and is charging you for misconduct, and this seems to be a preparation to terminate and deny any payments to you. Company may forfeit security paid by you.

It shall be appropriate to approach a local service lawyer asap with all records. Your lawyer shall be able to get you, your rights.
