SERVICE TAX ON LAWYERS

If an individual lawyer provides following services, will it be correct to say that he is not liable for any service tax?
Rs.5 lacs  Individual to individual (No service tax)
Rs.5 lacs  Individual to Business entity (advice, consultancy and assistance) (No service tax)
Rs.9 lacs  Individual to Business entity (representation service before sourt)(Less than the limit of taxable service of Rs.10 lcs).

Pl specify.

Hi mani

yes service tax is not payable.


Rs.5 lacs  Individual to individual no service tax

Rs.5 lacs  Individual to Business entity (advice, consultancy and assistance) (Service tax payable)

Individual to business entity for representing no service tax

So, overall amount taxable is Rs. 5 lacs less than basic examption limit so no service tax payable

Basic service tax rate in 10%

Add: Education cess @2%

Add: SHEC @1%

so net effective rate is 10.3% including Cess and SHES
