sinking fund utilisation

Respected members,

I am staying in a housing society in Dombivili(E), Dist. Thane, which is having 40 flats constructed in 1978.

Recently ,  Our Society have conducted Spl.Gm for constructing shed over the terrace of the building in the I Phase and to  attend the structural work in the II Phase and Painting of the building in the III Phase.

Certain group of members have the opinion to utilise the Building Development fund for the Shed Construction of the I Phase and the balance pyable towards the II & III Phase of the work (Structural repairing & Painting) can be withdrawn from the Sinking fund.

Further as per the recent GR of Maharashtra Government , Withdrawls can be made for the major repairing/structural  work from the Sinking fund without the prior permission of the Dy.Registrar.

In this juncture as a senior  Society member, I would like to have your legal advice whether the Sinking fund (1) has to be replinished  (2) the period of replinishment, since GR has not mentioned any thing.

'SINCE SINKING FUND IS FOR EMERGENCY/CONTINGENCY PURPOSE, YOUR VALUABLE OPINION IS SOUGHT.
