Site under sarfesi act having issues

Sir,

I brought site for 32 lacs from Bank under SARFESI Act. I paid 30% of the amount to the bank. Now we came to know that there is encroachment case on the site. Can I put a deformation case on the bank manager and get back my money with interest.

Sir,

I brought under e-auction.

Conditions are as follows:

The property is sold in "AS IS WHERE IS and AS IS WHAT IS CONDITION" and the intending bidders should make discreet enquires as regards to any claim, charges on the property of any authority, besided Banks's charges and should saisify themselves about the title extent, quality and quantity of the property before submittingtheir bid. No claim of whatsoever nature regardig the property put for sale, charges / encumbaraces over the property or any other matter etc., will be entertained after submission of the online bid

you did not tell us about the exact nature of the case going on in that property, visit the concerned banks advocate and get his version on this, and lodge a complaint with the manager regarding this have a copy and if you are sure about the case ,that bank had colluded with the borrower in this sale, lodge a police complaint against the concerned erring officials, and ensure FIR is filed ,then they will fall in line.

for recovery of money u have to file a case only in consumer forum, provided if you have all set of original documents of the property, and u should obtain the ongoing case details on that property thru RTI, and should make use of the same, in consumer case.
