Soceity property

Hi,

This is a registered ngo society property for sale in chennai. The property documents are clear.

The property is on trustee name and all taxes are being paid in his name.

What is the procedure to buy such soceity property ? Is there any need to get approval from soceity registerer for selling it?

Any suggestion depends upon the bylaws of the Society and the law governing its registration.

Respected sir,

Thanks for your reply.

We got following reply from the seller . He states that

The property, movable and immovable, belonging to a society registered under this Act, if not vested in trustees, shall be deemed to be vested, for the time being, in the governing body of such society, and in all proceedings; civil and criminal, may be described as the property of the governing body of such society

Also he says that

"This is from the 1975 Act under which we are registered. No clause in this  act requires that we have to spell out "specific right to sell," as all the rights of the property is vested (has the Power) with Trustee or the Committee."

So he has all power/ authority to sell the property and registerer approval is not needed.

Is it correct sir. Or is there any other procedure that we need to follow while buying such property.

Tia
