how do we ask the court to lift a special leave if imposed in an Ex partie order
my Friend has got an expartie order aganist her in a criminal suit where the judge of the High court mentions that without special leave of this court, no action can be taken on this criminal case.
where is this application is to be passed to lift this special leave.
Matter of High court,New Delhi.
These are the remedies in case an exparte is imposed on you -
1. Application to the court by which any such order is passed to set it aside: Order 9 Rule 13.
2. Preferring an appeal against such decree: Section 96(2) (or file a revision under Section 115 where no such appeal lies).
3. Apply for review: Order 47 Rule 1.
4. File the suit on the ground of fraud.
