Status of litigants

Dear Sir ,

              1-  Whether the status of applicant and the prospective accused in lower court can be changed by impleading a new party ( State) by higher court in Revision himself by the Court (Revision against order u/s 156(3) of Cr. P. C.)?

              2- Whether a notice can be issued to the opposite parties / prospective accused in revision , against the order u/s 156(3) of Cr. P. C.? If Yes the pl. provide citation.

Sir,

           An application u/s156 (3) of Cr.P.C. was filed before the C.J.M. Sitapur . The same was rejected .Agreeved And dis- satisfaction a Revision was filed before the D.S.J. Sitapur . Notice was issued to the prospective accused but it was objected that no notice can be issued at this stage because the prospectve accused did not come in picture till F.I.R. loged . Thereafter , The Court rejected my application providing two Citations by saying that inform to the State (G.A.) fixing the another date .  On the fixed date G.A. objected and it was noted in order . The matter is pending.
