I have presented a cheque through my Banker, it is returned with a memo payment stopped by the drawer, (the person who has given me the cheque) it attracts 138 of NIA

First give the statutory legal notice, informing the drawer of the cheque about the cheque having been returned by the banker without making payment.

Demand the drawer to make payment of the money mentioned in the cheque within 15 days from the date of receipt of the notice, failing which appropriate legal action will be taken including filing of a complaint under Sec. 138 of the Complaint.

If you do not get the payment from the drawer of the cheque, within 15 days of the receipt of the notice by him, then file a complaint u/s. 138 of the N.I. Act.

You have to be very careful about the time limit for issuing the legal notice, and also the time limit for filing the complaint.

Therefore, without wasting time, issue the statutory legal notice.
