A land of 7.5 acre of X was cared by Y,on 15.12.1974 a as given by X to his real brother Y and the said attorney was withdrawn by X in 1987 due to family problem. In 1993 Chakbandi was started & x real brother converted the name of X in favour of his 2 son by ground of said attorney. further the ground of conversion is that since we have cultivating the land from 30 yrs & the land owner X has given power of attorney (Mukhtaraam) . in mean time X was murdered by Y 2 sons in 1994. as per sec-52 of UP ZA & LR act land the name Y 2 sons were incorporated in chakbandi register.at the time chakbandi there was a loan in the name of X in SBI against the property.
my request is to learned counsel is that since chakbandi has over, the Y has died,land is in possesion of Y 2 son, can X son file a suit after spend of 15 years for fradulantly incorpration of land in Y 2 son , if yes where ? the land is in Uttaranchal.
