Introduction:
The Indian Media, Advertising and Entertainment Industry has seen tremendous growth to emerge as one of the most competent industry sectors in the global market. However, along with the growth patterns it has witnessed there have been various regulations that bring about a new set of business challenges.
For any year now there is yet no clarity on the practical and commercial implications of amendments to the Copyright Act 2012. The signing of Beijing Treaty for Audio Visual Performance and compliance of current copyright act with the treaty needs further analysis as well as lacks a direction.
There is an urgent need for all stakeholders to have a clear picture on the true nature of the amended copyright act on a number of issues that include commissioned works, assignment of copyrights, DRM, protection of moral rights, dissemination over digital rights to name a few. Nonetheless, the most perplexing issue that needs addressing is related to royalty, its payment and distribution.
Regulatory changes have made it difficult to sustain for the existing business ecosystems, with expected revenue squeeze with Ad caps, high carriage fees and below par subscriptttion revenues. To ensure an immediate change in the business sense, the current differences between LCO, MSO & Broadcasters need urgent resolution. Furthermore, the process of regulation regarding content and over objectionable advertisement for TV, Radio and internet too falls under grey area and has no apex body to monitor.
