Suit of declaration of title-property dispute

my father has been residing on a house for more than 40 years.  he has not papers of the property.  last year two person started claiming ownership by threatened my father through police.  At last we have to file a case for permanent injunction.  these two person have fake documents and they earlier appeared in court but we gathered proof to prove them wrong.  both have now not appearing in court.  One defendant is expartee and another one is also going to be expartee in one or two hearings.  my lawers tells me that now I should file a case for declaraton of title.  he told that it should be filed in time as it may become time-bar.  But I do not want to file this case of declaraion of title until the second party also becomes exparte and permanent injunction is granted to us.  please advice.
