Supplementary charge sheet filed

Accused charged under section 376 IPC read with secion 4 of Pocso Act 2012, accused totally deny charge. Swabs fom the private parts of the minor victims was collected by the doctor including semen from the private parts of the girl, which was send to FSL. The IO of the case filed only preliminary charge sheet without FSL report and the case is  now fixed for argument. Can the court pass judgment without the FSL report. Is pocso  very stringent that the court can convict the accused under section 4 of the act without FSL report with supplementary charge sheet. Victim statements not credible and witness statements full of contradictions.

This equally applies with the accused? Dont you think that the accused too has a right to fair trial?
