Symbolic possession

Dear Sirs,

Bank has given Demand Notice through two news papers (One in Marathi & One in English) and said that if we don't pay the amount to the bank,within 60 days of publication of the notice,they will be be constrained to intitate proceedings under section 13(4) / 14 of the SARFAESI Act against the flat.

Now nearly 120 days are over ,Bank has yet to take symbolic possession.Now I have asked to my lawyer to issue a notice to the bank as bank has issued loan to unauthorised person. This means unless bank takes symbolic possession of the flat are we going to keep mum. We cant take any legal action against bank?

Please clarify.
