Temperary employees

Sir,

 

I would like to know whether PF and ESI is covered for any temperary employess who are not in the roles of the company.

 

And if so what is the ceiling of payment for which there is any exemption if any.

Dear Krishnaraj,
It is mandatory for everyone to be covered under PF and ESI whether they are in the role or not except apprentices, who are covered under Govt Apprentice Act. But normally we are not contributing to PF and ESI for the members who are not in the rolewhich has to be compromised with authorities.

As such there is no ceiling limit given to salary to exempt them from paying this.

As per law
[font=""Arial""]a) to every establishment which is a factory engaged in any industry specified in Schedule I and in which twenty or more persons are employed and

(b) to any other establishment employing twenty or more persons or class of such establishments which the Central Government may by notification in the Official Gazette specify in this behalf :

Provided that the Central Government may after giving not less than two months' notice of its intention so to do by notification in the Official Gazette apply the provisions of this Act to any establishment employing such number of persons less than twenty as may be specified in the notification.
