Tenant not vacating the property

Hi All,

 

My Father is having a 3 floor house in UP, on the ground floor there is a 2BHK flat, A lady teacher (Junior High School) was rented ground floor home some 7 months back, with out proper lease, since we decided to sell this property, we told her some 4 months back to vacate the property, initially she said she needs some time, which was duely given to her, but she refused to vacate the property and stopped giving any rent or contribution towards electricity or water bills altogether. 

When we tried to argue her to vacate the property she has started complaining against my father at various police offices CO office, SP Office etc that My father is troubling her and trying to force her to make physical relations with him, she is also accusing us that she has given a rent advance for 6 months. Can we force her through court to start giving the rent and electricity bills, can we cut the electricity supply to her floor or the building altogether.

Every day or other she will create some scene or other. The local police chauki incharge has come for inquiry and threatening my father that he will register a court case untill unless we grease his palm. This lady has got a similar history with atleast previous 3 landlords once we enquired about her.

She has also lied with us that her husband is cancer patient and lives in delhi, while we have recently come to know that she has walked out of his home and have soem extra maritial relationship with some guy living in our neighbourhood (The Guy don't want to co-operate with us).

Dear lawyers please let me know what options do we have to get her out of our property.

For that you have to initiate legal proceeding. Firstly send her a legal notice duly drafted by an advocate. And thereafter suit for eviction has to be initiated.But before all you have consult with a lawyer all with all relevent papers. After that necessary steps can be taken.

It is very hard to tell you in that way. It depends case to case. It may be finished with in one year if every thing wil be on its track or may be futher extended. If any issue you can contact me through my email id anirbangope@rocketmail.com.
