Terminate from job eventhough completed 240 days of work

Dear All,

Myself have received call letter from Employment Exchange regarding vacancy in "Panchayat Irrigation Department in Porbandar for work Charge Mistry" in year 1985(Interview dt. 11-1-1985). I got selected and appointed as "Work Charge Mistry" on 12-1-1985 on temporary base for 29 days.

1. Letter from Panchayat Irrigation Department, Junagadh to Porbandar department no. asta/54/90 dt. 18-01-1985.

Then after I got letter of appointement after every 29 days period.

I received my following appointment letters as below during year 1988, for which I have completed more than 240 days continuously.

2. Period : 20-02-1988 To 29-02-1988 Order no. 149 dated 19-02-1988.

3. Period : 01-03-1988 To 31-03-1988 Order no. 491 dated 01-03-1988.

4. Period : 01-04-1988 To 06-07-1988 Order no. 816-818 dated 28-03-1988.

5. Period : 07-07-1988 To 08-12-1988 Order no. 1739 dated 07-07-1988.

6. Period : 09-12-1988 To 20-12-1988 Order no. 2493 dated 08-12-1988.

We have applied in the Civil Court earlier in Porbandar but case was out as this case is of Labour Court. Then again we filled in Labour Court and just now on 03-05-2012 (Ref. no. LCJ No. 244/2004) Labour Court has given its final judgement that applicant has not completed required days of job during his duty.

 

We would like to require the further guidance for the same. By giving other points and discussion labour court has discarded our case and not consider the working days of applicant.
