My opponent without any basis had lodged a false complaint basing on which FIR was registered. It had been now for more than one year, he had not turned up in giving of his statement to the investigating officer on account of which the matter is pending on the file of the Magistrate Court towards recording of the statement u/s 167 of Cr.P.C. For how long the matter shall be in pending? Can i move any petition with the Magistrate Court towards closure of the case on account of wilful default being made by my opponent in the said false case?
