Tp u/s. 408 of crpc

I want to file Transfer petitioner u/s. 408 of Cr P. C.  For transfer of Complaint from that Court to any other Court

1. Can I make the Ld. Magistrate as a party to the case ?
2. Do I need to make ‘Original Respondent in Complaint’ as a party in the Transfer petition
3.  
4. Only state can be made as Party

Kindly give me Draft of T.P. u/s. 408 of CR PC, if available

Kindly guide, I am confused
