Transfer in wbsedcl

I am working in WBSEDCL(A Govt. of West Bengal Enterprise) since August 2010. Initially I was posted at Asansol which is 1 Hour distance from my Hometown Chittaranjan of same district. My brother is a mentally and physically challenged and having Handicapped Certificate issued by AIIMS, New Delhi and my widow mother is working in Chittaranjan Locomotive Works a Production Unit of Indian Railways. She is aged nearly 50 and having high blood presure(on medicine), cervical spondilities, and recently gone through a major surgical operation. Due to these reasons I have already applied for transfer to more nearer office of WBSEDCL at near my locality.

But in the year 2014 nearly 130 staffs and officers from Asansol Division of WBSEDCL suddenly transfered to very far distanced offices without any reason. I also became the victim of this inhuman tansfer and got posted at Patashpur Electric Supply Office under Contai Division of Purba Medinipur District. The distance nearly 350 Kilometer from my home. I became very helpless but finally joined and abide by the Transfer order. Immediately after joining I applied for transfer to the Higher Authority( G.M. HR&A at Vidyut Bhavan at Saltlake Head Office of WBSEDCL). No action was seen from higher authority. I again and again applied for transfer to nearby offices to my home as My widow mother was helpless to live with such a handicapped boy alone without my active support. I submitted all medical documents , brothers handicapped certificate and also requested personally to the Senior level managers. But they just consolated me. Even I visted head office with my handicapped brother and requested. But all went in vain.

This was one side. On the other side many transfer orders are being continuesly issued and many of the transfered employess get back to their nearby offices. But my request was not answered till today. And there are active interventions of political leaders.

Firstly our transfer was totally unjustified and there are gross violations going on reagrding transfers in WBSEDCL in returning back of employess to their hometown or home district.

In this situation what should I do to get justice. I am near to complete 2 years in transfered posting. Please suggest.

Its batter to file a case in Tribunal or high court regarding the disposed of your representation. If in the meantime the authority disposed of your representation against you then you prayer in the OA / Writ will be the transfer you near your local area.

It is important that whatever you mention here that you have to show by document (prove by document ).

Firstly thanks for listening to me.

Sir I can give all documents such as

1)My applications to the higher authority from time to time.

2)Other transfer orders after my application.

3)All documents in favour of my mothers illness and brothers handicapped certificate.

It is said from the higher authority that after Assembly elections in West Bengal my transfer order may be realesed. Should I wait for that or go to the high court.
 

What is the proceedure to file a case against my employer. Can I directly write a letter to The Honourable Chief Justice of Calcutta High Court.

recently a staff union appealed to the labour commisioner and they ordered immediate ngotiation to the WBSEDCL higher authority. So we all staff who victimised of this inhuman transfer waiting for our transfer. after assembly election.

If the conciliation before the labour commissioner fails, the said dispute can be referred to the labour court/ industrial tribunal for adjudication. All disputes related to Industrial Disputes Act has to tried at labour courts/ industrial tribunal as High Court does not have the power to hear the matter at the initial stage. 

 

Better to consult a lawyer with all relevant documents.

Although unions have taken up the matter, it shall certainly be better to engage an able counsel specialzing in labor matters.
