Transfer of flat

DEAR SIR – I STAY IN MUMBAI IN A MHADA BUILDING. MOTHER IS THE OWNER OF FLAT (SHE IS ALIVE).  NOW I WANT TO TRANSFER ON MY NAME (I AM HER SON).

OUR SOCIETY HAS TAKEN CONVEYANCE. HENCE SOCIETY WILL TRANFER THE FLAT.  WHETHER STAMP WILL ATTRACT  & WHAT ABOUT REGISTRATION?????????

IS THERE ANY ROLE OF MHADA ????????????

SECONDLY I HAVE ONE SISTER WHETHER HER NOC IS REQUIRED?????

LASTLY SHALL I TRANSFER NOW OR LATER ON AFTER MY MOTHER. WHAT WILL BE HEADACHE IF I TRANSFER LATER ON?????????

your mother needs to execute a registered gift deed in your name. thereafter you need to apply for transfer of flat in your name in the society.

it should be nominal for transfer in the blood relation i.e. 1% of the value.

As rightly advised by Adv.Dalmia (above), mother should Execute a duly stamp duty paid registered Gift deed.  Gift Deed does not require NOC from anybody, whosever.  Property Transfer effected during life-time of Gift-Maker, is irrevocable and safest and indisputable, subsequently.


Stamp Duty = 2% of property's ready reckoner rate (for blood relations)
Registration fees = 1%  OR  30,000 (which ever is lower)
MHADA transfer fee = approx. 32000/- plus  (compulsory)
