Transfer of the judge just before judgement date

 

 

         If after final arguments in a criminal case (accident case) judge is transferred just few days before the judgement date and case is transferred to another judge, then what is the impact of this on the case and will final arguments be repeated again.

Dear Querist

No there is no need to argue the matter again but if the court think fit then the court may pass an order for further final argument or the court may pass the order as per the case.

No , not necessary to repeat the arguments mostly judges go through the case in brief and comments written by the previous judge and pass the order , but sometime judges pass an order for final argument and then pass the order.

Does it mean that arguments given by defence advocate are documented by court on the day of arguments itself?
