TRUST DEED

In our locality we have constructed one religious school wherein we plan to conduct classes for muslim students to teach them basic religious matters alongwith remembering of quranic verses and may be two subjects eg english and mathematics wil betaught. We plan to charge very less amount towards fees. The land property on which the school is built is a waqf property which is waqf in favour of a masjid which is situated nearby in the locality. we are members of the committee of the masjid as such we are looking after the affairs of the school also. Our masjid is not registered in waqf also the school. Our committee is a unanimously elected committee and there is no objection raised by any other fellow in masjid. Now we want to make a legal committee of the school. Is it possible to form a trust and run the mosque and the school under it with the same commitee members. What are the legal provisions in this regard and what are the precautions to be kept in mind. Is it legally correct to do so if not what is the correct and safe method. We donot want to give room to any other elements to misuse the places of worship. Hence we want to have total control ujpon them. Aslo please clarify whether government servants can be members of committee or trust which is going to be formed.

You can form a trust to manage the mosque as well as school by same trustees. There is no legal hurdle in this matter. No Govt. servant should be included in such trust.
