Us divorce

Hi,

Divorce under "irreconsilable differences" is ongoing in the US. Both parties have mutually consented and voluntarily participated for divorce. Both are represented by respective lawyers. The divorce would be granted after 6mo the petitioner filed for it. A couple of questions:

1. If the couple was still liing together when the divorce was filed and would have been living separately for 5mo when the divorce would be granted, would it be still be valid in India?

2. Is this divorce in any way violation of HMA Sec 13-B(1) and (2) and hence an exception for Sec 13 of CPC for such a divorce to be invidated in India. The exception I am talking about states - "Where it sustains a claim founded on a breach of any law in force in India"

Kindly advice.
