I'm employed with a company in Bangalore. I was granted H1B visa through the company for a period of one year from Oct'12 to Sep'13
I was sent to the US under H1B visa in Nov 2012. There was an employment contract that I signed during that time, which said that I'm obliged to be with the company for atleast 24 months from the date of travel to the US. In the event of contract breach, the employee has to pay $10,000 to the employer.
For personal reasons I had to come back in May'13 to the India division of the company. My H1B visa expired in Sep'13. I'm still e the company and I'm planning to resign in April 2014 as I'm going for higher studies.
What will be the consequences of violating the contract? Should I have to pay $10,000? My contract ends only in Nov 2014, I cant stay until that as my college will begin soon. Is there a way to escape the consequence? Please help.
