Visitation

Earlier queries have been raised that child access and custody guidelines is only meant for family courts in Maharastra . Please find below a letter where in the chief justice has circulated this to all the hon'ble judges of the bombay high court which indirectly would mean to be binding on the lower courts . So fathers facing DV cases where in they have applied for visitation at times are countered by the judge's of JMFC courts  or even the opposite counsel that this is meant only for familycourts which after reading of the attached letter is not so.  .Apart from this under supervision too nobody can be  denied  visitation. Any Junior /Senior Lawyer /Counsel /Professional person worth his salt   can debate on this topic as to why visitation should not be granted ( leaving aside criminals ).If iam not mistaken even they too would get it under police supervision .
