Want to move case to high court

Hi Exports,

I am staying in Maharashtra and basically from Andhra. My wife went to Andhra to another dist. and put 3 cases on me.

498A

Maintained

Domestic violence.

 

They literally went to a rural place where there is a good support for then and suffering me and my family. I even not able to find good Lawyer.

Last 1 year I lost so much financial, health, and job.

Now I am planning to as high court to move the cases at least in high court. Please suggest me the better way.

Generally courts biased towards women, so chances of moving case to high court minimal.

Bestway is use mediators and settle the matter. Else 498a and other cases 2 to 3 years to settle the things. However all cases depends on merits.

Conviction rate in 498a is as low as 2% and that too if it involves any injuries. Make sure chargesheet is filed and fight the case on merits.

Dear Anand,

For the forum to guide you better, please answer the following questions:

1. What are the conditions and statements on which you have gotten bail.

2. Has your chargesheet been filed?

3. Why does your lawyer or you want to move to the HC. Have you confirmed how you can directly move the case to HC without fighting in lower court.

3. Once you get chargsheet, things become easier to fight.

 

Suggest you answer these questions so forum members can guide you better.
