The time limit to file charge sheet is related to arrest of the accused in the case. The charge sheet is to be filed within 60 days from the date of arrest of the accused in cases triable by lower courts and 90 days in cases triable by Court of Sessions.

Dear Mr Suresh,

Although the query is poorly worded however what I could understand is that you have been named in FIR falsely. The IO does not have enough evidence for trial. You want to know if the charge sheet can be cahllenged.

Yes, the FIR and charge sheet can be challenged. You have two options (1) File a discharge application OR (2) File quashing under Section 482 Cr PC.  Option (1) is convinient and less costly. You can take your decision as to what to do.
