respected sir,
my appeal u/s.378 got admitted but the accused remain absent Hon'ble Bombay High court passed an order of appeal admitted but not directed the accused to present also not gave any direction for presence of accused my question is can i press fresh misc application U/s. 390 to Hon'ble High Court or JMFC, Mumbai from where the accused got acquitted complaint u/s. 138 N. I Act.

you may move an application before the trial court u/s437A of the crpc, provided the trial court has passed the order of acquittal on or after 31st december 2009
