Whether a Company can take membership of Housing Society

With this post I would crave your indulgence for getting answered the querry "as to whether a Company could be a member of a group housing society".

Yes a company can be a member of housing society. A company has an identity of a individual, it may own property. So there is no hurdle to become a member of a housing society.

Though in legal parlance a company can be termed as a person and be granted certain similar rights of a natural person, the rights for a company in a housing society would in large be governed only by the Bye Laws of the society. 

 

If the housing society's bye laws expressly restricts the entry / membership of a company or any commercial enterprise certainly a company has no place to seek entry in society.

No Society can prevent a company from becoming a member. In the past, government allotted lands to certain societies which wanted to build houses for its members and restricted membership on the basis of caste, community and religion. It was upheld even by the Supreme Court. This practice has been done away with and no distinction can now be made.

There are many flats in my society which are in the name of companies, banks and firms.
