Raveena Kataria (Advocate )     04 July 2017

Yes, a third party can be admitted to a civil/family case under Order 1 Rule 10 of the Civil Procedure Code. The following requirements need to be met before the court can accept such application or by its own accord add another party to the suit:

-If it appears that such a person is party to the dispute or has interest in the subject-matter of the dispute

-If the multiplicity of proceeding/suit is being avoided by means of adding such party in the current dispute

-If it appears that the admission of such party will put the court in a better position to "effectually and completely adjudicate upon and settle all the questions involved in suit;" Order 1 Rule 10 (2).

Hope this helps!
