Hi,
My brother in law wants to file divorce case against his wife. Both are not living together since last 3 years. First he tried for out of court settlement. But now his wife claiming that both are still having relations which family dont know. Even they have physical relationship which is not true. We have confirm this with my brother in law also he also denied it.
I know that both should have to prove this in court. my questions are
a) who will have more advantage if his wife come with her claim in court?
b) How to encounter her claim? Because we are sure that she won't be able to produce proofs.
