My runaway wife is suffering from Cervical spondylosis. she and her family did not tell her medical condition before marriage. due to her medical condition she does not perform any house hold work, can this be used for declaring the marriage null and void ?

Dear Querist
as per section 12(1) (c) of Hindu Marriage Act-1955
(c) that the consent of the petitioner,........................................... was obtained by force or by fraud as to the nature of the ceremony or as to any material fact or circumstance concerning the respondent.
An Annulment petition can be filed but you have to proved that there is any force of fraud has been committed to obtain your consent for this marriage then only you can get the annulment order otherwise you petition may dismissed.
