Good evening,

A will is a legal document or declaration created by any person regarding his property, assets and what should happen to the same after their death. It can be modified, revoked or substituted by the person who drafted it, at any point in their lifetime. A clear and written will is necessary, and it helps unnecessary problems among legal heirs. You'll need to make sure to mention these points in your will-

  • A declaration stating that you are in your right sense of state, and don't forget to mention your name, age, address, and the time of the day when you're writing the will.
  • A list of your assets and documents you own that you wish to mention here, such as land, bank fixed deposits, the house, or any such asset/property. Don't forget to mention where these documents are as well.
  • Mention who gets what part of your assets, as in mention the ownership of assets and in what proportion.

Make sure to sign the document or will in the presence of two people, or two witnesses, and have them sign the will as well, as proof that they indeed were witnessing your signing.

A will can be executed on a plain paper. If you want to register it, you can approach the sub registrar office with the witnesses, in your district and ask for assistance there. A registered will can serve as a strong legal evidence as well.

Please do consult your lawyer in order to know more about wills.

Hope this helped,

Regards,

Nandini.

There is not anyperticular format, will is a statement one makes and that is natural and usual.

There are certain clauses which should be mentioned while drafting a will, which can not be taught on this platform.

It is better to consult and engage a local prudent lawyer for appreciation of facts / documents, professional guidance and necessary proceeding.
