Withdrawal of resignation

Hi

One of my friend resigned from his MNC (pvt ltd co ) job because of a petty dispute with boss, on 30th April. Resignation was accepted and last date of working was given as July 31st. Now he wants to withdraw his resignation, which is not accepted by HR. Is there any legal remedy to wthdraw accepted resignation before the last day of working?

Resignation already tendered with the notice period and the notice period is likely to complete.  At this stage, on making an application for withdrawal, it will depend purely on the discretion of the employer to accept his withdrawal application or to reject it.  Legally the decision of the employer is tenable.

Take a letter in writing by the employer saying that your resignation has not been accepted by the HR and they have no objection of his continuing his services.  There were some misunderstanding between the employer and you. Now the problems have been sorted out.
