Workmens compensation act

 

 

Dear Sir,


 


 

Good evening.


 

My name is Roopa and I am absed out of Hderabad


 

I am writing this mail to you to seek little help regarding the various Labor Laws applicable for a small company. Please read below.


 

As of now, I am working as a “HR Consultant” in NICEFIT Careers Pvt. Ltd at Hyderabad. This company is into: Recruitment services, IT development and also Assessment driven Skill Enhancement training. It has a manpower of over 25 and is keen to extend its operations across the country. We are governed by the S&E (Shop & Establishment Act). We are a 5 year old company.


 

Please note that except 2- all other employees are outside ESI purview as their Gross salary is more than Rs 15000. Also, , we have taken a Bajaj ALlianz policy for GPA (Group personal Accident policy) which covers only death and not disablement.


 

My queries are:-


 

  1. I want to know if the Workmen's Compensation Act is applicable for us?

  2. Do we need to cover even disablement too - in our GPA policy

  3. Those two employees whose gross is less than Rs 15000 need to be covered. Right?

Hi

 

Your organization covers under the ESI act, where as non coverable under the ESI only WC is mandatory.

 

Two employees less than 15k, but your total strenght is cross the cieling. so you have to obtained the ESI code and pay the contribution for those two employees.
