Divorce Transfer Petition Objection

Hello All,

I am sending the legal notice to her and depending on the reply I may file a divorce case against her ( If she files false 498a and DV  against me ).

I may file the case from Bangalore but if she goes to SC and request for Transfer to her state ( WB ) then will I be able to object. I staying in B'lore with my mom and she is there with her family. My relatives are there is Assam and her in WB. As if transfered then it will be difficult for me to fight the case as travel from B'lore to her place is a quite a lot of distance as in senaio my Job may be lost if I got for more leaves.

* I agree to beer the travel expences for her and her companion and stay in Bangalore.

Also if I have AB from B'lore then how easy it will be to get AB from her state(WB).

My Question are:

1. Can I object if she tries to transfer divorce petition?

Pls let me know your suggestions ?

You have lesser chances of success . Better if you try for conciliation.

Definetly you may object but try to solve the matter amicably. even then if you face any problem then let us know, we will solve your problem.

Hello All, Thanks for the reply. But I want to know why do you feel that I have less chance  to win.

In the legal notice i am just mentioning the incidents and requesting her  come back.

We talk about transfer petition only coz now a days law is in favour of girl even men are right.

But it is not settled law and may be you will win but our openion is based on 60% chance. So you have 40% chance to win in trnasfer case but in divorce case you will win.

In family matters no one wins. both parties are loosers. Even getting judgment in one's favor is not his/her victory .

we are not war advisors rather this is  a socio-legal forum. we should  advise what is actually in the interest of a person and society at large.

one who is adament to fight a case as a war at any cost , he may contact paersonally to a lawyer of his choice and be ready to pay according to lawyer's demand.

Thanks for the answer. Also I want to ask whether it is possible to get divorce 2 years decease.

How do I prove it. She has left without telling me.
