Electronically issued relieving or experience letters

Dear Sir / Madam,


Today, most of the employers are issuing Relieving Letters and Experience Letters electronically i.e. in soft copy format via email to the employees or ex-employees personal email account, after successful Full and Final Settlement of dues is settled. These letters or documents also have the digital signature of the authorized signatory, just like the FORM 16 which are issued by employers with digital signatures of their respective authorized signatory.


Are electronically generated and digitally signed documents (Employment Experience Letters) legally valid?


I came across the IT Act, 2000 and after having read the main points and from my little understanding gained from it, electronically generated and digitally signed documents appear to be acceptable by law and approved under IT Act 2000.


Could you please suggest any authority who can provide in writing that such electronically generated documents are legally acceptable. Perhaps, the Ministry of Communication & Information Technology of Government of India should be in a position to issue a clarification. Am i right?
