How my legal seperation with my family will help in 498A, DV

Hi,

 

Can any law expert would let me know that if I legally get seperated from my family members now, then how can that will help my family members in case of 498A, DV filed against me & my family members by my in-laws. Right now my wife is living with me but we can get seperated soon and I suspect 498A, DV etc. if I will file the divorce. I am finding ways to keep my family members as much safe as possible from these cases. Any suggestions.

Nobody can stop youe wife from falsely implicating you and your family members even after the legal separation. She can narrate the stories when you were staying together with your family, what will happen then?

By legally separating now, you can help your family members by two ways -

1. Police MAY not file a case on your family members if your request them  - Very diffcult

2. If a case is being filed on your family members then it can help a little in getting them a bail.

Please also await expert's suggestions on this.

Give two options to someone; jump from ground floor room window and or jumb off from a table which one you will pick as safe landing bet ! :-))))))

1. "Ex - communicating" you is more safer bet in such situation. Meaning thereby that your name issued "in future legal corresspondence" your family will not be responsible to accept. 
2. With above you will not be living with them legally and still enjoy all the family related (off the records) ties.
3. If Im reading correctly your presented briefs then I see that you are hatchting "future options" in that case follow para 1 instead of opting for affidavit "dissowning" funda many suggest but is not future foolproof. With ex-communication it is "two way edge releif" which is as per whims and fancies of your side of family they can distance and come closer with you in "times of needs" or as the cause of action arise and or vice versa:-)
I will aslo suggest u to take on rent a worhless pad on your name as "resident of" if you forsee some legal activities from your inlaws side in near future. It will come greater handy than "dissowning parents" fundas.
4. Discuss above suggestions with a seasoned counsel and offcourse with your family members n act accordingly:-)

no help, if you staying ith them. advance speculation not good in field of law. you have to face a hard situation. let the complains come, there after find the solutions.

donot overweightage to the complains. complain to proove is a long run.
