I need a help in a case of property

I had purchased a land from my relative measuring 980 yards in 2005 which was mortgaged at that time. i purchased the land in 20 lacs & paid the 25% amount as a Beyana. We signed the aggrement in which we did not fix the date of registry because property was mortgaged. The land holder stated in the agreement that he will receive the remaining amount from me after clearing the loan amount. He was died in Aug. 2012. After that i came to know that he had cleared the loan in 2008 & sold the 200 yards out of 980 yards in 2008. Now i m thinking to file a suit to purchase the 780 yards. now plz tell me can i get the 200 yards back that have already sold. My contact is 9872158437 sarabjeetsingh1992@gmail.com
